By accessing the ASEANrooms.com website, mobile or tablet application, or any other feature or other ASEANrooms.com platform (collectively, 'Our Website'), you agree to be bound by these terms and conditions ('Terms') and our Privacy Policy. If you do not accept all of these Terms, then you may not use Our Website. In these Terms, 'we', 'us', 'our' and 'ASEANrooms.com' refer to LIMA’s Software and Apps, and 'you' and 'your' refers to you, the user of Our Website. This website is for your personal and non-commercial use. The content and information on this website (including, without limitation, price and availability of travel services), as well as the infrastructure used to provide such content and information, is proprietary to ASEANrooms.com or its suppliers and providers.

DEFINITIONS
- The Terms of Use (“Terms”) are between you (“you”) and Lima Asia Dynamics Group (“LIMA” “we,” “our” or “us”) and controls the use of any of our websites, including but not limited to ASEANrooms.com and other of our related websites, you are accepting all the practices described herein.

LIMA, or its third-party licensors, as applicable, retain all rights, title and interest in and to the Content and all intellectual property rights related thereto. - You may use the Site solely for your personal or internal business use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell the Site or any of its Content.
- All brands, names, logos, product and service names, designs and slogans incorporated into the Site are owned by LIMA, its affiliates or its licensors. Prior LIMA’s written permission is required to any use of it

- The Site may provide links to third-party websites or other websites of ASEANrooms’s affiliates or related and unrelated companies These links are provided solely as a convenience to you, and these Terms do not control the Unrelated Sites.
- Your access, reliance on and use of these links and any Unrelated Sites is entirely at your own risk and is subject to such Unrelated Sites’ terms and conditions. We are not responsible for, and will not have any liability or responsibility to you, for the content on, or your use of, any third-party website. Our inclusion of hyperlinks to Unrelated Sites does not imply any endorsement of such sites or the material found on them.

- You agree to comply with all applicable federal, state, local and international laws and regulations when using the Site. Additionally, you may not, without our express written, prior permission:
ACCOUNT SECURITY
- You must create an account to use the Services. We will collect and process your personal information, such as your name, electronic mail (e-mail) address, and your mobile phone number when you register to set up an account. You must provide us with accurate, complete, and latest information and agree to provide us with any proof of identity that we may reasonably request. We will collect, use, disclose and process your personal information following our Privacy Policy
- Only you can use your account and you represent and warrant that you will not authorize any other party to use your identity or your account for any reason unless permitted by ASEANrooms.com or LIMA. You cannot assign or transfer your account to any other party.
- You must maintain the security and confidentiality of your account password and any identification we provide to you. In the event of any disclosure of your password, in any way whatsoever resulting in any unauthorized use of your account or identity, order(s) received from such unauthorized use shall still be considered as valid orders and we will process such order(s). Subject to any rights you may have at law, you hereby declare that ASEANrooms.com is not responsible for any loss or damage arising from the misuse of your account.
- If you no longer have control over your account, you are required to notify us immediately, so we can temporarily block and/or inactivate your account. Please note that you are responsible for your use of your account and may be liable for your account even if your account is misused by others.
- ASEANrooms.com or LIMA reserves the full right to temporarily block, delete, or deactivate your account which is at our sole discretion and for any cause without giving reasons for blocking deletion, or deactivation of your account provided that this will not affect our obligations to provide any Services that have been purchased by you before that time (unless we also cancel those Services as permitted by these Terms). The reasons for blocking, deletion, or deactivation of your account may include but are not limited to: breach of these Terms, prohibitions in law or regulations, fraud or theft (or indication or suspicion of fraud or theft), suspicion of criminal activity, suspicious ordering, you are providing inaccurate, erroneous or misleading information, your inappropriate behaviour, threats, or insults, refusal to provide information, practical impediments, communication difficulties or breakdowns, or you are listed on their blacklist on governments or international organizations.
- As a condition of your use of the Site:
  - You agree that you are responsible for maintaining the confidentiality of Your account and password
  - You may not use anyone else’s account at any time to access the Site;
  - You must notify the Site immediately if You detect any unauthorized use of Your account; and
  - You are responsible for all activities that occur using your account.
CURRENCY CONVERTER
- If a currency converter is available on the Website, the currency rates displayed are based on various publicly available sources and should be used as guidelines only and we and/or our respective suppliers do not warrant or guarantee accuracy.
FEES CHARGED BY BANKS
- Some banks and card issuing companies impose fees for cross border or international transactions. For example, if you are making a booking using a card issued in a different country from the merchant's location, your card issuing company may charge you a cross border or international transaction fee. In addition, some banks and card issuing companies impose fees for currency conversion. For example, if you are making a booking in a currency other than the currency of your credit card, your credit card company may convert the booking amount to the currency of your credit card and charge you a conversion fee. If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank or card issuing company. ASEANrooms.com uses Paypal for credit/debit and Paypal transactions. We do not add the fees collected from consumers. ASEANrooms.com
ALTERNATIVE PAYMENT METHODS
- From time to time, we partner with providers of alternative payment methods including consumer finance companies to offer you an alternative payment method at checkout. For example, if we offer as an alternative payment method real-time financing options for the purchase of travel bookings on our Website that can be paid to the consumer finance company in fixed monthly payments. References on the Website to any names, marks, products or services of alternative payment providers or links to such provider's sites or information are not an endorsement, sponsorship or recommendation of an alternative payment provider or its information, products or services. We are not responsible for the content or the acts or omissions of any alternative payment provider. Your use of any such alternative payment provider's payment method is at your own risk and will be governed by such alternative payment provider's terms and policies.
OUR FEES AND COMMISSION
- ASEANrooms.com collect 15% commission as our fees. The calculation is based on the net rate charged by the Hotel and the Hotel is responsible for any taxes to be paid to the authorities
- Options. The guest pays either:
  - In full to ASEANrooms.com and we will forward the Full payment less the 15% commission to the Hotel within seven days upon check out to their assigned bank account
  - The Hotel may request us for Virtual card details as confirmation of booking/reservation
  - At times, full payment is made at the Property and not to ASEANrooms.com but this option is only for bona fide and registered businesses
BEST PRICE GUARANTEE
- All prices on the Site are for room reservations only, and the specified stay dates and number of people. It does not include meals (unless otherwise specifically stated) and other facilities. You are advised to check with Property for details
- ASEANrooms.com is dedicated to serve you with the most competitive room rates and strive to give you the lowest price possible for your stay at the Property
- Should you find your Accommodation room reservation, with the same booking conditions, at a lower price on the Internet after you have made a booking through us, we will match the difference between our price and the lower price under the Terms of Use of the Best Price Guarantee. Note: Promotions created by the Property whether direct or indirect is not applicable
- Claims for Best Price Guarantee should be directed to our Customer Service or through our email within 14 days after check-in.
ADDITIONAL CHARGES FROM HOTELS
- Please note that all prices for hotel reservations provided through our Hotel Prices are based on your selections, such as for the requested period of stay and number of guests, unless otherwise specified. Hotel Prices are quoted per room and night unless otherwise specified. You are responsible for verifying whether your selection and any additional requests or services are reflected in the price displayed on the Site (please refer to more details listed under "Hotel Information", "Requirements Booking", "Cancellation Policy" or similar headings on the Site) and/ or in the email-coupon confirmation. Breakfast is usually not included unless otherwise stated. Hotel resort fees and other mandatory costs (see description below) and local taxes, tourist, or occupancy charges (if any) will be paid by you and are usually not considered in the Hotel Prices unless otherwise stated. You are responsible for verifying any explanations or policies provided by the hotel on the Site. Insurance of any kind is not included in the Hotel Prices unless otherwise stated. The standard hotel room reservation is for one or two guests; an additional charge will usually be required for an extra bed. The hotel can refuse to accept additional guests if not notified in advance.
- Please note that some hotels may charge you a resort fee but may require additional charges (or the like) to use certain services. The resort fee is usually not included in the Hotel Prices; more details will be included in the hotel’s description on the Site. You may also be charged directly by the hotel for products and services including but not limited to: energy surcharge, baggage handling fees, the cost of delivery of newspapers, in-room security costs, travel/tour fees, or the cost for cleaning the rooms under extraordinary circumstances. This practice of additional hotel charges is beyond our control.
- Optional incidental expenses and personal consumption charges (such as those incurred during the Hotel stay) are not usually included in the Hotel Price. Such charges include but are not limited to: parking fees, in-room minibar charges, telephone charges, room service, food and beverage costs, special (gala) dinner costs, movie rentals / movies-on-demand, and Internet usage costs. During certain peak holiday seasons, some hotels may make their special dinners compulsory (such as for the New Year, Christmas, Chinese New Year and other events). Such charges are not included in the room rate but will be displayed on the booking form. Please refer to more details listed under "Hotel Information", "Requirements Booking", "Cancellation Policy" or similar headings on the Site. If you are unsure whether or not a charge is included in the tariff, please contact our Customer Service to clarify.
- Certain hotels may add fees for transport or transfer to and from the airport. This is a common practice for travelling between islands, to reach the hotel. Such transportation is always governed by the hotel and is offered by or on behalf of the hotel, which is responsible for the transportation service. ASEANrooms.com does not arrange any transport and is not responsible for such transport service. You agree that ASEANrooms.com is not responsible for the quality, safety, frequency or service level of the transportation services, and for any loss or damage that may result from the use of such transportation services.
- In some jurisdictions, hotels may be required by law to directly collect occupancy tax or local city tax from guests. Government authorities may also declare additional taxes and may require the hotel to collect such taxes directly. You agree to pay any of such taxes/costs to the hotel directly upon checkout unless otherwise specified. If you have any questions, please contact our Customer Service regarding any additional costs that may be included in the Hotel Price.
RATINGS
- Ratings shown on the Site are only provided for the information of users only, and existing ratings are based on the information given by third parties such as suppliers, users or other review websites. We do not verify the rating given and are therefore not responsible for the accuracy of the existing rating, nor do the ratings constitute any endorsement (or otherwise) by us. In no event shall ASEANrooms.com be responsible for any claims, losses or liability concerning the ratings shown on the Site.
RESPONSE TO VIOLATIONS
- ASEANrooms.com and LIMA reserve the right to take any action we determine is necessary if we believe that your use of the Site violates these Terms, infringes the rights of any person or entity, threatens the personal safety of any person or entity, is a Prohibited Use, or could create liability for LIMA. Any such action by LIMA does not limit our rights or remedies at law or in equity.
DISCLAIMER OF WARRANTIES AND LIMITS ON LIABILITY
- The Site is provided “As Is” with all faults and defects and without warranty of any kind, whether express or implied including, without limitation, all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement and warranties that may arise out of course of dealing, course of performance, usage or trade practice, without limitation to the foregoing, LIMA makes no representation of any kind that the site will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or site, operate without interruption, meet any performance or reliability standards or be error-free, that any errors or defects can or will be corrected, that the information therein will be suitable for your needs or the site is free from viruses or other harmful components. LIMA may make improvements and/or changes to the site at any time without prior notice, the inclusion of any product or service on the site, does not constitute any endorsement or recommendation of such product or service by LIMA Some jurisdictions do not allow the exclusion of or limitations on implied warranties or the limitation on the applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to the user
- In no event shall LIMA be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, or use of the site or with any delay or inability to access, display or use of the site, including our investigation of your use of the site, whether based on a theory of negligence, contract, tort, strict liability, or otherwise, and even if LIMA has been advised of the possibility of such damages
- If despite the limitation above, LIMA is found liable for any loss or damage which arises out of or is in any way connected with any of the occurrences described above, then the liability of LIMA will in no event exceed, in the aggregate, the greater of (a) the fees (if any) you paid to for access to the Site, or (b) One-Hundred United States Dollars (US$100.00).
- The limitation of liability reflects the allocation of risk between the parties, and LIMA would be unwilling to make the Site available to you without such limitations. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed its essential purpose. The limitations of liability provided in these terms inure to the benefit of LIMA.
INDEMNIFICATION
- You agree to indemnify, defend and hold harmless LIMA, its affiliates and their officers, directors, employees, agents, affiliates, successors and assigns from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees resulting from your:
  - breach of these Terms;
  - violation of any law or the rights of a third party; or
  - use of the Site or any of the Contents.
FEEDBACK
- Please be aware that by submitting suggestions, comments or other feedback related to the Site or Content (collectively, “Submissions”), you hereby assign to LIMA all your worldwide right, title and interest in and to all Submissions, even if you have designated such Submissions as confidential. You agree to promptly assist as may, in LIMA’s opinion, be necessary to document, perfect and maintain LIMA’s rights in the Submissions. Furthermore, you shall ensure that the Submissions shall not infringe any right of any third party. If you do not agree to these terms and conditions, please do not provide us with any Submissions.
MEMBERSHIP PROGRAM
- By registering with ASEANrooms.com, you will automatically be a member of our loyalty program named “KorporateXpress” operated by Lima. (See KorporateXpress.com)
- As a member of KorporateXpress, you will gain access to the points, promotions, discounts, features, or other benefits offered by ASEANrooms.com and/or the third party
- Vendors as made available from time to time on the Site. For the avoidance of any doubt, we may, to the extent permitted by law, change, remove, or make unavailable part or whole points, promotions, discounts, features, or other benefits offered by us following applicable laws, provided that we provide reasonable prior notice of changes on our website. It is your responsibility to update yourself with our latest in this website
GENERAL TERMS
- You hereby consent to the exclusive jurisdiction and venue of courts located in Malaysia, for all disputes arising out of or relating to these Terms or use of Site.
- If any part of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired. Our failure or delay in enforcing any provision of these Terms at any time does not waive our right to enforce the same or any other provision(s) hereof in the future.
- These Terms constitute the entire agreement between you and LIMA concerning the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and LIMA concerning the Site. Your obligations to indemnify LIMA, along with any other part of these terms which, by their nature should survive termination of these Terms or your right to use the Site, shall survive.
- You acknowledge that irreparable harm would result in the event of breach by you of these Terms and that monetary damages in such event could be inadequate to compensate LIMA. Consequently, in the event of a breach of any of these Terms, LIMA is entitled, in addition to such monetary relief as may be recoverable, to such temporary, preliminary and/or permanent injunctive relief as may be necessary to restrain any continuing or further breach of these Terms, without showing or proving any actual damages or posting a bond or comparable security. Any rights not expressly granted herein are reserved.
